Blank Rome partner Anthony Rapa will serve as a panelist at the American Bar Association Science & Technology Law Section’s 2025 Privacy and Emerging Technology National Institute, being held March 20 through 21, 2025, in Washington, D.C.

Anthony’s session, “Border Crisis? Avoiding Trouble in Cross-Border Transfers of Personal Data,” will take place on Friday, March 21, from 10:30 to 11:30 a.m.

ABOUT THE SESSION

In a digital world that knows no borders, businesses are mobilizing to maximize the value of what could be their most valuable asset: data (including personal data). But that data is continually crossing borders of countries that each require compliance with their own distinct data protection laws. This session will focus on two recent U.S. developments regarding data transfers: (1) the EU-U.S. Data Privacy Framework (“DPF”) administered by the U.S. Department of Commerce, and (2) the U.S. Department of Justice’s proposed rules to implement President Biden’s executive order on preventing countries of concern from accessing U.S. bulk sensitive personal data. The DPF allows U.S. businesses to transfer the data of customers across the Atlantic without running afoul of European data protection laws such as the EU (and parallel UK) General Data Protection Regulation. The proposed restrictions on bulk sensitive personal data exports are more targeted and affect the transfer of large quantities of personal data to particular countries (and persons/entities associated with those countries) that are deemed to present a potential risk to U.S. national security.
