New York State Governor Kathy Hochul signed the Foreclosure Abuse Prevention Act (“FAPA”) on December 30, 2022, which became effective immediately. FAPA amends the Real Property Actions and Proceedings Law, General Obligations Law, and Civil Practice Law and Rules and applies to all actions commenced under CPLR 213(4) and in which a final Judgment of Foreclosure and Sale has not been enforced. Thus, FAPA retroactively applies to pending actions, not just new actions.
